JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 13-11-2017 Heard the learned counsel for the petitioner as well as learned Additional Public Prosecutor.

Though from the possession of the petitioner only 2kg ganja has been recovered but, on disclosure, from different persons 5kg and 2kg ganja was recovered, respectively. Learned counsel for the petitioner has submitted that the kiosk was not belonging to the petitioner nor the petitioner was apprehended there from. From his physical possession, nothing has been recovered. He happens to be under custody since 02.06.2017 having no criminal antecedent save and except accused in one Complaint Case No. 264C/2001.

Learned Additional P.P. opposed the prayer for bail. Considering the fact that the recovery of ganja has been

Learned lower court is directed to expedite the trial. If the trial is not concluded within one year, the petitioner will be at liberty to renew his prayer for bail.
