This application has been filed on behalf of the petitioner for modification of the order dated 20.11.2017 passed in Criminal Misc. No.55106 of 2017 by this Court with regard to extend the period of surrender of the petitioner, above named, in the court below in connection with Bagaha P.S. Case No.493 of 2015.

Learned counsel for the petitioner submits that vide order dated 20.11.2017 passed in Criminal Misc. No.55106 of 2017 by this Court, the petitioner and one Sunil Kumar, in the event of their arrest or surrender before the court below within a period of four weeks from that date, were ordered to be released

Patna High Court Cr.Misc. No.67528 of 2018(2) dt.02-01-2019 2/2 on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Bagaha, West Champaran, in connection with Bagaha P.S. Case No.493 of 2015, subject to the condition as laid down under Section 438(2) of the Cr.P.C. but due to unavoidable circumstance, the petitioner could not surrender before the court below within time in connection with the aforesaid case. In that view of the matter, learned counsel for the petitioner prays for extension of the period of surrender of the petitioner in the court below in connection with the aforesaid case.

In view of the aforesaid submission of the learned counsel for the petitioner, the period of surrender of the petitioner in the court below in connection with the aforesaid case is further extended for a period of four weeks from today. With the aforesaid modification in the order dated 20.11.2017 passed in Criminal Misc. No.55106 of 2017, this application stands disposed of.
