====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offence punishable under Sections 272, 273, 420 of the Indian Penal Code and Section 30 (a) (b) (c) of Bihar Excise Amendment Act.

It is contended that, as per allegation, about 3006 liters of foreign liquor were recovered from the truck. The petitioner is not named in the FIR. He is neither the driver nor the owner of the aforesaid truck. The owner of the truck has wrongly stated before the police that he had sold the truck to the petitioner. It is urged that the petitioner is in custody since 15.05.2017. It is claimed that his antecedent is clean.

Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on

Patna High Court Cr.Misc. No.43687 of 2017(2) dt.21-09-2017 2/2 furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge-II, Gopalganj in connection with Kuchaikote P.S. Case No.60 of 2017 with a condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.

However, one of the bailors must be belonging to the State of Bihar.
