JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 273 of the Indian Penal Code and Section 47(a) of Bihar Excise (Amendment) Act, 2016. In huge quantity, Indian made foreign liquor and beer are said to have been recovered from a vehicle in which petitioner and others were found sitting.

Submission on behalf of the petitioner is that coaccused, Bablu Kumar Bhagat, having more or less similar allegation, has already been granted privilege of bail by a coordinate Bench of this Court vide order dated 19.09.2016 passed in Cr. Misc. No. 40104 of 2016.

Mohit, learned A.C.J.M. IInd, Purnea in connection with Baisi P.S. Case No. 100 of 2016.
