The petitioner seeks bail in Fatuha P.S. Case No. 101 of 2005 registered under Section 341, 323, 307, 379 and 504/34 of the Indian Penal Code.

It is a case of misuse of the bail.

It is submitted by learned counsel for the petitioner that the petitioner was earlier on bail but his bail bond was cancelled on 05.06.2012 due to non taking of pairvi in the case. He has suo motu surrendered on 30.06.2017 and since then languishing in custody. The matter has been compromised between the parties.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond

Patna High Court Cr.Misc. No.39521 of 2017 (02) dt.19-08-2017 -2of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 7th Additional District and Sessions Judge, Patna in connection with Fatuha P.S. Case No.101 of 2005, corresponding to Sessions Trial No.1528 of 2005, with a condition that petitioner should remain personally present before the learned court below on each and every date and if he fails to present on two consecutive dates without any plausible reason, his bail bond shall stand cancelled.
