The petitioner seeks bail in a case registered for the offences punishable under Sections 363, 365 and 120(B) of the Indian Penal Code.

The informant, wife of Munna Bhagat made allegation against the petitioner and other persons that they brutally assaulted her husband and kidnapped him.

It is submitted that the entire allegation is false and concocted. All other accused persons Om Prakash Bhgat, Manju Devi, Chandan Kumar Bhagat, Madan Kumar Bhagat @ Madan Kumar Jaiswal, Lalu Bhagat @ Lal Mohan Jaiswal @ Lala Bhagat and others have already been enlarged on anticipatory bail vide orders passed in Cr. Misc. No. 21295 of 2015. The petitioner had

Patna High Court Cr.Misc. No.37519 of 2015 (2) dt.26-08-2015 2/2 also filed anticipatory bail, but he was arrested, therefore his anticipatory bail was withdrawn. The case of the petitioner stands on the same footing.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in Barari P.S. Case No. 55 of 2015.
