ANJANA MISHRA ORAL ORDER 19-09-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 21.06.2016 in connection with Phulwaria P.S. Case No.94 of 2016 registered for the offence under Section 394 of the Indian Penal Code. Subsequently, charge sheet under Sections 396 and 412 of the I.P.C. was submitted against the petitioner. Learned counsel for the petitioner submits that though the petitioner has been in custody since long, neither has any recovery been made from him nor has he been put on T.I. Parade. It is further submitted that several other coaccused having similar allegations have been released on regular bail by a series of the orders passed by this Court,

Patna High Court Cr.Misc. No.40851 of 2017 (3) dt.19-09-2017 2/2 vide Cr.Misc. No.32104, 29906, 35751, 26088 all of the year 2016.

Taking into consideration the aforementioned facts and circumstances and also the period of custody, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Raghubir Prasad, Judicial Magistrate 1st Class, Begusarai, in connection with Phulwaria P.S. Case No.94 of 2016.
