The petitioners apprehend their arrest in Bangaon P.S. Case No. 18 of 2014 registe4red under sections 323, 341, 447, 353, 379/34 of the Indian Penal Code. The informant made allegation that while he was discharging the duty of Angan Bari the petitioners along with others came and assaulted the informant and tried to strip her cloth.
It is submitted that the occurrence took place on 28.03.2014 but the first information report was lodged on 29.03.2014 when the police station is 4 k.m away from the place of occurrence. It appears that the informant made allegation against the petitioners that they have not only assaulted her but also tried to strip her cloth.
Patna High Court Cr.Misc. No.40902 of 2014 (3) dt.01-04-2015 2/2 Considering the aforesaid facts, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected. Petitioners are directed to surrender before the court below and seek regular bail and the court below shall consider the regular bail application of the petitioners without being prejudiced by the order of this Court.
