The petitioner seeks bail in a case registered under Sections 364[A], 120(B) and 34 of the Indian Penal Code. The prosecution case in short is that, the informant received call from mobile of his brother that he has been kidnapped by four persons from Mauna Bazar and ransom amount of Rs. Two lakhs was made in lieu of setting him free. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 06-06-2019. Charge sheet has already been submitted. The petitioner has been falsely implicated in the present case. The victim has been recovered

Patna High Court CR. MISC. No.51761 of 2019(4) dt.16-11-2019 2/2 and his statement under Section 164 of the Cr.P.C. was recorded in which, he has not named the petitioner. The petitioner has been made accused in the present case due to mistake of fact. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bikramganj, Rohtas in connection with Nasriganj P.S. Case No. 113 of 2019.
