ANJANA MISHRA ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 25.07.2016 in connection with Barsoi P.S. Case No.93 of 2009 registered for the offence under Sections 392 and 411 of the Indian Penal Code.

It is submitted by the Learned counsel for the petitioner that the F.I.R. is against unknown persons and nothing has been recovered either from his house or from his possession. It is further submitted that his name has been drawn in on mere suspicion as he is a social activist and generally used to raise his voice against the illegal action of the police.

Patna High Court Cr.Misc. No.40748 of 2016 (3) dt.24-11-2016 2/2 Considering aforementioned facts and circumstances and that the petitioner has no criminal antecedents and also because there has been no recovery from his possession, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar, District-Katihar, in connection with Barsoi P.S. Case No.93 of 2009.
