ANJANA MISHRA ORAL ORDER 08-10-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Dharhara P.S. Case No. 25/2018 registered for the offences punishable under Sections 302/120B of the Indian Penal Code. Learned counsel for the petitioner submits that there is no eye-witness to the occurrence and the petitioner is not named in the First Information Report. However, on the basis of the confessional statement made before the police by one Pappu Sharma, the petitioner's name has also been dragged into the present case and is apprehending his arrest. It is further submitted that one Bhutush Yadav whose name has also surfaced on the basis of the confessional statement has since been extended the privilege of anticipatory bail vide order dated 23.08.2018 passed

Patna High Court Cr.Misc. No.61729 of 2018 (2) dt.08-10-2018 2/2 in Cr. Misc. No. 46502 of 2018.

Considering the aforementioned facts and circumstances and since the petitioner has got no criminal antecedent, let the petitioner in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned A.C.J.M. 1st, Munger, in connection with Dharhara P.S. Case No. 25/2018, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
