This application is for grant of regular bail in connection with Sherghati P.S.Case No. 278 of 2017 registered for the offences punishable under Sections 147, 148, 149, 325, 307 and 302 of the Indian Penal Code.
Allegation against the petitioner and other co-accused is of assaulting the deceased by sharp cutting weapons causing his death.
Submission of the learned counsel for the petitioner is that no sharp cutting injury was found on the person of deceased and only lacerated injury has been found on the dead body and he is in custody.
Heard learned A.P.P. also and the learned counsel for
Patna High Court Cr.Misc. No.49791 of 2017 (3) dt.09-11-2017 the informant who opposed the prayer stating that several injuries were found on the person of the deceased.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner. However, the learned trial Court is directed to expedite the trial.
With the aforesaid observation, this application is dismissed.
