The petitioners seek bail in anticipation of their arrest in connection with Haspura P.S. Case No. 144 of 2018 dated 28.06.2018 instituted for the offences under Sections 341, 323, 325, 308, 504 and 34 of the Indian Penal Code.

While deliberating over the issue of partition in a family, an occurrence took place in which the petitioners are said to have assaulted the informant and others.

Learned counsel appearing for the petitioners has submitted that the petitioners as well as the informant are agnates and come from the same stock of family. The occurrence took place because of frayed

Patna High Court Cr.Misc. No.57711 of 2018(2) dt.11-12-2018 2/2 tempers during the talks of partition. There is no specific accusation against the petitioners and the order sheet also does not depict that any grievous injury was caused to the informant or anybody.

Considering the background facts and the circumstances in which the occurrence took place, the petitioners are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Aurangabad in connection with Haspura P.S. Case No. 144 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
