Petitioner seeks bail in connection with Bhorey P.S. Case No. 104 of 2006 registered under Sections- 304B, 201 and 34 of the Indian Penal Code.
Prosecution case in short is that informant's daughter was married to Hardyalal Chauhan. Informant came to know that his daughter is not in her matrimonial house. Thereafter he made search of his daughter. Informant suspected the hands of the accused including the petitioner in committing murder of his daughter.
Learned counsel for petitioner submits that petitioner is Devar and is separate from the husband of victim
Patna High Court Cr.Misc. No.49790 of 2016 (2) dt.16-12-2016 in mess and property. It is further submitted that co-accused Awdhesh Chauhan and Bishundev Chauhan have been granted bail by this Court vide Cr. Mis. Nos. 24290 of 2016 and 24368 of 2016.
Considering the facts and circumstances of the case and the fact that co-accused persons have been granted bail by this Court, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ramsakal Ram, Judicial Magistrate, 1st Class, Goptalganj, in connection with Bhorey P.S. Case No. 104 of 2006.
