JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-08-2019 The petitioner has approached this Court against the order dated 26.7.2019 passed by the Special Secretary, Education Department exercising appellate jurisdiction by which he has vacated the stay granted by order dated 1.7.2019. It is admitted by the counsel for the petitioner that the appeal has not been disposed of as yet.

In view of the above, during the pendency of the appeal, filing of the present writ application is misconceived. It

Patna High Court CWJC No.16829 of 2019(2) dt.20-08-2019 2/2 is, accordingly, dismissed.

However, the appellate authority is required to dispose of the appeal at the earliest preferably within a maximum period of 45 days from the date of receipt/production of a copy of this order.
