====================================================== CORAM: HONOURABLE JUSTICE SMT. NILU AGRAWAL ORAL ORDER 29-11-2017 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in connection with Sasaram (Muffasil) P.S. Case No. 633 of 2017 for offences punishable under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case, as lodged by the informant, is that while he had gone to attend the reception, petitioner along with three others opened fire by their country-made pistols in a drunken condition. One hit the informant on his arms and one hit Golu Kumar and both were injured.

It has been submitted by the learned counsel for the

Patna High Court Cr.Misc. No.48223 of 2017 (3) dt.29-11-2017 2/3 petitioner that he is innocent, bears no criminal antecedent and in paragraph 6 of the case diary it has come that one Pradeep Sonkar had opened fire. He submits that the injuries are not on the vital part of the body, petitioner is languishing in custody since 21.08.2017 and good relations have prevailed between the parties.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sasaram (Muffasil) P.S. Case No. 633/17, subject to the conditions that :

(i) One of the bailors would be a close relative of the petitioner having sufficient immovable property, who will file an affidavit stating his relationship with the petitioner.

(ii) Petitioner will appear before the learned court below during trial as and when required and failure to appear

Patna High Court Cr.Misc. No.48223 of 2017 (3) dt.29-11-2017 3/3 on two consecutive dates without assigning any reason will entail cancellation of his bail bonds.
