JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-11-2017 The petitioner seeks regular bail in connection with Asthawan P.S. Case No. 120 of 2017, registered for offences punishable under Sections 147, 149, 341, 323, 307, 504 and 506 of Indian Penal Code.

Allegation against the petitioner is of firing on the informant causing injury to him.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and though there is allegation of firing against the petitioner causing injury to the informant, however, the injury has not been caused on vital part of the body. Further he has been in custody since 24.07.2017 and has no criminal antecedent.

Heard learned A.P.P. also.

No.45832 of 2017 (4) dt.21-11-2017 Having heard both sides, considering the fact and circumstances of the case and also the fact that the injury caused to the informant was found to be grievous in nature, at this stage, I am not inclined to release the petitioner on bail rather this application is disposed of with direction to the court below to release the petitioner on bail to his own satisfaction, once charge is framed in this case on filing undertaking that he will cooperate in disposal of trial and make himself available as and when required except on some genuine reasons.
