JUSTICE BIRENDRA KUMAR ORAL ORDER 01-11-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 376 of the Indian Penal Code.

Allegation against the petitioner is of physical exploitation of the informant on pretext of marriage. Submission is that false allegation is there. Petitioner was never in relation with the informant. Just to pressurize for marriage, false allegation has been levelled. Considering the nature of allegation against the petitioner, I am not inclined to enlarge him on anticipatory bail in connection with Khagaria Mahila P.S.Case No.39 of

Patna High Court Cr.Misc. No.59536 of 2018 (2) dt.01-11-2018 2/2 2018 pending in the court of learned Chief Judicial Magistrate, Khagaria.

Hence, prayer is refused.

Petitioner is directed to surrender within three weeks.
