The petitioners apprehend their arrest in Navinagar P.S. Case No. 179 of 2021, registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code and section 3/4 of the Prevention of Damage of Public Property Act.

As per the prosecution case, 76 named and 300-400 unknown persons started pelting stones and damaged the police vehicle. It is further alleged that they also created hindrance in the discharge of official duty of police officials. It is submitted that allegation is general and omnibus

Patna High Court CR. MISC. No.66121 of 2021(2) dt.14-07-2022 2/2 and no specific overt act has been alleged against these petitioners.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Aurangabad in connection with Navinagar P.S. Case No. 179 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
