The petitioner seeks bail in Korma P.S. Case No. 39 of 2016, registered for the offences punishable under Sections 272, 273 and 34 of the Indian Penal Code and under Section 47(A) of the Bihar Excise (Amendment) Act, 2016.

The house of Jhagdu Paswan was raided and 45 liters of country made liquor was recovered. Gita Devi, wife of Jhagdu Paswan did not produce any paper. It is alleged that Gautam Ram, the petitioner and Suraji Raj were manufacturing country made liquor and supplying.

Learned counsel for the petitioner submits that nothing has been recovered from possession of the petitioner. The petitioner has got criminal antecedent and that is why name of the

Patna High Court Cr.Misc. No.43204 of 2016 (3) dt.13-12-2016 2/2 petitioner surfaced in the case. The petitioner is in jail since 17.08.2016.

Considering the facts aforesaid and the fact that nothing has been recovered from possession of the petitioner and the petitioner is in jail since 17.08.2016, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Sheikhpura in Korma P.S. Case No. 39 of 2016.
