The petitioners seek bail in a case registered for offences under Sections 272 and 273/34 of the Indian Penal Code and Section 30 (A) of the Bihar Prohibition and Excise Act, 2016.

It is contended that as per allegation, 250 bottles each containing 300 ml, i.e., total 75 litres of Nepali Soufi wine were allegedly recovered from the possession of the petitioners. Petitioners claim that they are having clean antecedent and are in custody since 01.06.2017.

No.40375 of 2017(2) dt.25-08-2017 2/2 Considering the facts and the circumstances of the case, the petitioners, above named are directed to be released on bail on his furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge-VIIcum-Special Judge, Excise Act, East Champaran, Motihari in connection with Chhauradano (Mahuawa) P.S. Case No. 82 of 2017 with a condition that if the petitioners, after their release in this case, are again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of their bail bonds.
