The petitioner is in custody since 02.09.2016 in connection with Vibhutipur P.S. Case No. 201 of 2016, registered for the offence punishable under Sections 25(1-B)A, 26/35 of the Arms Act.

Learned counsel for the petitioner submits that recovery of a pistol was made from a vehicle in which five persons were found to be seated and petitioner is said to be one of them.

Considering the facts and circumstances of the case and similarly situated co-accused persons, namely, Raman Kumar and Rajesh Kumar have been granted regular bail on 20.10.2016 passed in Criminal Miscellaneous No. 45571 of 2016, let the
