This application is for grant of regular bail in connection with Bheldi P.S.Case No.73 of 2017 for the offences under Sections 413 and 414 of the Indian Penal Code. Allegation against the petitioner is about recovery of three stolen motorcycle from his house.

Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated in this case on the basis of suspicion and nothing is there to show that those are stolen motorcycle and he is in custody for about three months. Further submission is that one of the co-accused has been granted bail by this Court, from whom one motorcycle has been recovered. Heard learned A.P.P. also, who has opposed the

Patna High Court Cr.Misc. No.43413 of 2017 (2) dt.22-09-2017 prayer for bail on the ground of recovery of three motorcycle and the petitioner is accused in two other cases also and one of them is under Section 379 of the IPC.

Having heard both sides and in view of allegation, I am not inclined to grant bail to the petitioner at this stage and this application is disposed of with direction that once the charge is framed or he completes six months' period in judicial custody, whichever is earlier, the learned court below shall release the petitioner in connection with Bheldi P.S.Case No.73 of 2017. With the aforesaid observation, this application is disposed of.
