JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-10-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Manigachhi P.S. Case No. 90 of 2017, registered under Section 304(B)/34 of the Indian Penal Code.
The accusation is of killing the daughter of the informant by her husband and in-laws due to illicit relation of her husband with another lady.
Learned counsel for the petitioners submits that petitioners are father-in-law and mother-in-law of the deceased, daughter of the informant, in fact, occurrence of marpit took place in between the decease and her husband due to making allegation
Patna High Court Cr.Misc. No.47646 of 2017 (2) dt.09-10-2017 by the deceased at her husband about illicit relation with another lady. The petitioner no. 2 made intervention and also informed to the informant. Later on, the deceased, daughter of the informant, committed suicide, but with ulterior motive the present case has been lodged with false allegation. Moreover, Kanhaiya Singh, husband of the deceased, is in custody.
Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M.-VI, Darbhanga, in connection with Manigachhi P.S. Case No. 90 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
