Petitioner is named in the first information report but it is specific against co-accused, Vijay Yadav and Ishwari Yadav that they opened fire on the deceased. Moreover, prior to filing of the present case, petitioner had lodged Masaurhi (Bhagwanganj) P.S. Case No. 236 of 2006 against the deceased of the present case and others.

No doubt, the alleged occurrence took place in the year 2008 and petitioner could be remanded in this case on 24.09.2014 but taking note of this fact that petitioner is cooling his heals behind the bar since 24.09.2014 and he does not have any criminal antecedent, let the petitioner be released on bail on
