JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and has been made accused in a complaint case for the offence punishable under section 304B of the Indian Penal Code The contention on behalf of the petitioner is that the deceased had delivered a baby prior to her death but after delivery of baby her condition started deteriorating and when she was taken to hospital she died on the way. It is further contended by him that the complainant and his family members gave threatening to petitioner of dire consequences and thereafter immediately
Patna High Court Cr.Misc. No.37209 of 2015 (2) dt.01-09-2015 2/2 petitioner gave information to police upon which one ASI inquired about the death of the deceased and found that the deceased died due to excess bleeding. It is further pointed out by him the post mortem on the corpus of the deceased was held and the post mortem report also corroborates this fact that deceased died due to excess bleeding.
Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Patna city in connection with Complaint Case No. 226 of 2012.
