Petitioners apprehend arrest in connection with Gaunaha P.S. Case No. 11 of 2018 registered for the offence punishable under sections 4, 26A of Bihar Minor Mineral Concession Rules, 1972 and section 15 of the Forest and Environment Act.
Learned counsel appearing for the petitioners submits that petitioners have been falsely implicated in this case. The only allegation levelled is that the petitioners did not deposit the required tax, but from the documents annexed as Annexure-2 it would be apparent that petitioner has already
Patna High Court Cr.Misc. No.57682 of 2018(2) dt.10-10-2018 2/2 deposited the tax amount in question. Petitioners are men of clean antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Bettiah, West Champaran in connection with Gaunaha P.S. Case No. 11 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C. (Arvind Srivastava, J) mcv/- U T
