JUSTICE PRABHAT KUMAR JHA ORAL ORDER 23-04-2015 Heard Mr. Sanjay Singh, learned counsel for the petitioner, nobody appears on behalf of the State. The petitioner seeks bail in Asthawan P.S. Case No. 29 of 2013, registered for the offences punishable under Sections 409, 419, 420, 477, 468, 471 and 120B of the Indian Penal Code. The petitioner is alleged to have received Rs. 18,80,750/- loan from the bank sanctioned in the name of different person. The petitioner is ready to deposit the entire amount with admissible interest thereof.
Learned counsel for the petitioner submits that he shall deposit Rs. 2,50,000/- within two weeks and thereafter the petitioner shall deposit the remaining amount in eight installments. Considering the facts aforesaid, the petitioner above
Patna High Court Cr.Misc. No.41576 of 2014 (5) dt.23-04-2015 2/2 named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda in connection with Asthawan P.S. Case No. 29 of 2013, subject to the condition that the petitioner shall deposit Rs. 2,50,000/- within two weeks from today and thereafter he shall pay in eight equal installments per month the entire remaining amount. If the petitioner fails to deposit any installment his bail bond shall be cancelled. The deposit shall be subject to the result of this case.
