The petitioner seeks bail in connection with Bakhtiyarpur P.S. Case No. 115 of 2017 dated 03.05.2017 instituted for the offences under Sections 341, 385, 324 and 307 of the Indian Penal Code.
The petitioner is alleged to have given a knife blow to the informant for his refusal to pay money for drinking toddy. It has been submitted on behalf of the petitioner that an absolutely false case has been instituted against him and that there was only a minor scuffle between the informant and the petitioner. The injury suffered by the informant is stated to be simple. The petitioner had earlier been made accused in two other cases, in which he is on bail.
Patna High Court Cr.Misc. No.47894 of 2017 (4) dt.03-01-2018 2/2 The petitioner is in custody since 22.06.2017. Considering the nature of injury suffered by the informant and the period of custody undergone by the petitioner, this Court is inclined to grant bail to him.
The petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Bakhtiyarpur P.S. Case No. 115/2017.
