The petitioner seeks regular bail in connection with Basantpur P.S. Case No. 245 of 2017, registered for the offences punishable under Sections 272, 273, 308 of the Indian Penal Code and Sections 35(A)(B) and 36 of Bihar Excise and Prohibition Act, 2016.
Allegation against the petitioner is of recovery of 21 bottles of foreign liquor each containing 280 ml. from his house and he is an accused in Basantpur (Lakadi Nabiganj O.P.) P.S. case also.
It has been submitted on behalf of the petitioner that he has been falsely implicated in this case and he has remained in custody for more than two months Heard learned A.P.P. also.

No.46095 of 2017 (2) dt.19-09-2017 2/2 Having heard both sides, in view of the allegation as well as criminal antecedent of the petitioner, this application is disposed of with the direction to the court below to release the petitioner to his own satisfaction once charge has been framed in this case or after completion of four months of judicial custody of the petitioner, whichever is earlier, if a petition is filed on behalf of the petitioner.
