No. 4395 of 2013 and analogous cases (Akhauri Bijay Prakash Sinha and Ors versus The State of Bihar and Ors), the Lab Assistants and Demonstrators have been indicated to be not Teachers, now no action can be taken for granting any benefit to the petitioner. Once the issue in question
Patna High Court MJC No.3849 of 2014 (3) dt.18-10-2017 2/2 with regard to the category of Lab Assistant and Demonstrator not being Teacher is upheld by the Hon'ble Supreme Court, in view of the above, no case is made out for proceeding further in the matter.
