Two petitioners, who are in custody in Sukhani P.S. Case No.10 of 2016 registered for the offence under Section 414 of the Indian Penal Code and Section 7 of the Essential Commodities Act, have prayed for grant of bail. It was submitted by learned counsel for the petitioners that petitioners are having clean antecedent, which fact has been stated in paragraph-3 of the petition. He submits that the petitioners are in custody since 10.07.2016.
Learned Addl. Public Prosecutor, opposing the
Patna High Court Cr.Misc. No.40618 of 2016 (2) dt.04-10-2016 2/2 prayer of the petitioners submits that huge quantity of Kerosene Oil was recovered from the possession of the petitioners, whereas no document was produced by them.
Be that as it may, keeping in view the nature of accusation, period of custody as well as clean antecedent of the petitioners, let the petitioners, namely, (i) Md. Jahangir Alam @ Jahangir Alam (ii) Matiur Rahman be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) each with two sureties of the like amount each to the satisfaction of Sri K.K. Chaudhary, J.M.1st Class, Kishanganj in connection with Sukhani P.S. Case No.10 of 2016.
