The petitioners seek bail in a case instituted under Sections 147, 148, 149, 323, 307, 302 and 504 of the Indian Penal Code.
The allegation against the petitioners is that they along with other accused persons assaulted the brother of the informant on his head and chest by lathi-danda with an intention to kill him. As a result of which, the deceased fell down on the ground. Thereafter the co-villagers took him to hospital for treatment, where the doctor declared him to be dead.
Patna High Court Cr.Misc. No.42410 of 2016 (2) dt.05-10-2016 2/2 It has been submitted on behalf of the petitioners that the petitioners are in custody since 28.07.2016. There is no allegation of tampering of witnesses alleged against the petitioners. General and omnibus allegation has been made against the petitioners. No specific allegation has been attributed against the petitioners.
On behalf of the state, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-Vth, Purnea, in connection with Jalalgarh P.S. Case No. 139 of 2015 (G.R. No. 4687 of 2015).
