24-10-2016 Heard Sri Abhishek Kumar, learned counsel for the petitioner and Mr. Matloob Rab, learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 23-07-2016 in Piprahi P.S. Case No. 61 of 2016 registered for offence under Section 47(A) of the Bihar Excise (Amendment) Act, 2016, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that he was moving on a motorcycle, which was being driven by co-accused and while motorcycle was intercepted, the person, who was driving motorcycle, fled away and petitioner was apprehended. From the said motorcycle, about 25.2 litres of Indian-made foreign liquor was recovered. By way of referring to statement made in paragraph - 3 of the petition, he submits that

Learned Addl. Public Prosecutor has vehemently opposed the prayer for grant of bail.

However, considering the nature of accusation, period of custody and clean antecedent of the petitioner, let the petitioner namely Sachin Kumar Yadav be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar in connection with Piprahi P.S. Case No. 61 of 2016.
