This is an application for bail in connection with Jalley P.S.Case No. 118 of 2015 registered for the offences punishable under Sections 363, 366A and 34 of the Indian Penal Code. Petitioner is named in the FIR and allegation against the accused persons, including the petitioner is of kidnapping the minor daughter of informant and further it appears that in her statement under Section 164 Cr.P.C. that she has stated against accused persons, including the petitioner but in her statement under Section 161 Cr.P.C. she has not stated anything against the petitioner, rather allegation is made against one Chandan Kumar, who has taken her to Darbhanga.
Submission of learned counsel for the petitioner is that he has not done anything and he has falsely been implicated in this case and victim has alleged against one Chandan Kumar but he has been granted bail by the court below and he is in custody since

Heard learned APP also, who could not controvert the above submission.
Having heard both sides and in view of facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga, in connection with Jalley P.S.Case No. 118 of 2015, subject to the following conditions :
(1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner shall co-operate in trial and appear on each and every date in court, failing which his bail bond shall be cancelled.
