JUSTICE SANJAY PRIYA ORAL ORDER 2/ 26-09-2018 This application has been filed for modification of the order dated 03.08.2018 passed in Cr. Misc. No.43555 of 2018 by which petitioner has been granted provisional anticipatory bail in connection with Dev P.S. Case No.44 of 2018 to the satisfaction of Chief Judicial Magistrate, Aurangabad, with certain conditions.

Counsel for the petitioner submits that in compliance of the order dated 03.08.2018 passed in Cr. Misc. No.43555 of 2018, petitioner has deposited the 1/4th of the amount within time, but he could not surrender because he was suffering from illness. Wife of the petitioner has deposited the aforesaid amount in Madhya Bihar Gramin Bank. In support of such deposit, petitioner has annexed copy of the pay-in-slip of bank as Anneuxre-2 series of the Supplementary Affidavit.

No.59193 of 2018 (2) dt.26-09-2018 2/2 In view of such, four weeks' further time from the date of receipt of this order is granted to the petitioner to surrender before the Court below and, in that event, the Court below will release the petitioner on bail on the same terms and conditions as mentioned in order dated 03.08.2018 passed in Cr. Misc. No.43555 of 2018.

This Modification Application is, accordingly, allowed.
