JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 01-04-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner apprehends his arrest in Gopalganj P.S. Case No.311 of 2019, registered for the offences punishable under Sections 30 and 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner rather 62.130 litres of foreign liquor has been recovered from the car of the petitioner. It is further submitted that the petitioner has already sold his car to one Ravi Kumar Singh. It is also submitted that the petitioner has got no criminal antecedent as stated in para 3 of the bail application.

Patna High Court CR. MISC. No.66523 of 2021(2) dt.01-04-2022 2/2 Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Having considered the fact that the recovery of liquor is made from the car of the petitioner, I am not inclined to enlarge the petitioner on bail.

Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
