The State of Bihar .... .... Opposite Party/s ====================================================== CORAM: HONOURABLE JUSTICE SMT. NILU AGRAWAL ORAL ORDER 31-08-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in jail custody since 20.11.2014 in connection with Ahiyapur P. S. Case no. 507 of 2014 for the offence alleged under Section 396 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case is that on 14.9.2014 in the midnight 8 to 10 unknown persons committed dacoity in the house of the informant. While committing dacoity, they killed the husband of the informant, injured her brother-in-law and looted cash and jewelleries.

It has been submitted by the learned counsel for the petitioner that he has not been named in the F.I.R. and his name has surfaced during the course of investigation. It has further been submitted that no Test Identification Parade has been done so far. It has also been submitted that a coordinate Bench of this Hon'ble Court has granted bail to a similarly situated co-accused on 28.7.2015 in Criminal Misc. No. 27116 of 2015. I do not propose to take a different view.

Under such circumstances, let petitioner, namely, Lal

No.37146 of 2015 (2) dt.31-08-2015 2 / 2 Babu Sahni @ Kokra be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur, in connection with Ahiyapur P. S. Case no. 507 of 2014.

May it be noted that since the petitioner is involved in various cases of similar nature, if the petitioner hereinafter, is found accused in another case of similar nature, learned court below will be at liberty to cancel the bail bond of the petitioner. (Nilu Agrawal, J) sudip/- U T
