The petitioner has prayed for bail in a case instituted for the offence under Sections 341, 323, 302, 120B, 34 of the IPC and Section 27 of the Arms act.
It is a case of commission of murder to the informant's husband by gunshot injury by co-accused Vijay Pandey, Abhay Pandey, Arvind Tiwary and Chhote Pandey while he was returning to his house along with Umesh Tiwary. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Petitioner is not named in the FIR. Only on the basis of suspicion, as the conspiracy of committing murder of the informant's husband
Patna High Court CR. MISC. No.64320 of 2022(4) dt.16-05-2023 2/2 was made in the hotel of the petitioner. Save and except this, during investigation, no consistent material has come against the petitioner to show his involvement in the present case. Specific allegation is against FIR named accused and not against the petitioner. He has got no criminal antecedent and languishing in judicial custody since17.7.2022.
The application for bail is vehemently opposed by learned APP for the State and learned counsel for the informant. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Siwan in connection with Guthani P.S.
