JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-272, 273 of the Indian Penal Code and under Sections47/54 of the Bihar Excise Amendment Act, 2016. Thirty bottles containing 300 ml. each Nepali liquor are said to have been recovered from possession of the petitioner, for which, the petitioner is languishing in jail custody since 24-052016. The petitioner does not have any criminal antecedent and the investigation against the petitioner has already been completed.

Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection

Patna High Court Cr.Misc. No.46575 of 2016 (2) dt.25-10-2016 2/2 with Ghorasahan P.S. Case No. 146 of 2016 to the satisfaction of learned Sub Divisional Judicial Magistrate, Sikarahana at Motihari, East Champaran.
