Mr. Vinod Shanker Modi, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 02-02-2022 Heard Mr. Bijendra Kumar Singh, learned counsel for the petitioners and Mr. Vinod Shanker Modi, learned APP for the State via video conferencing.
Petitioners have renewed their prayer for bail inasmuch as earlier bail application of the petitioners was rejected by this Court on 19.10.2020 in Cr. Misc. No. 23009/2020 giving them liberty to renew their prayer for bail after one year if the trial does not show any progress and the petitioners are in custody since 04.12.2019.
This Court vide its order dated 01.12.2021 had called for a report regarding stage of trial from the court of Additional Sessions Judge, Purnea and in pursuance thereof, the report vide
Patna High Court CR. MISC. No.66651 of 2021(3) dt.02-02-2022 2/2 Letter No. 02/21 dated 04.01.2022 has been received from the said court stating therein that out of eight witnesses, two witnesses have already been examined and the trial court has given estimated time for completion of the trial within period of four months.
Taking into consideration the report submitted by 8th Additional Sessions Judge, Purnea, I am not inclined to grant regular bail to the petitioners at this stage. The same is, accordingly, rejected.
However, petitioners, if so advised, may renew their prayer for bail after four months from today if the trial does not conclude.
