JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 19-01-2017 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor.

Deceased, Mahendra Muni, who had gone to participate in an immersion procession on 22.02.2016, did not return whereupon hectic search was taken up during course thereof, his dead body was found in the maize field of Rajesh Kumar Singh on 24.02.2016. Informant, who happens to be his son, had shown suspicion against petitioners along with others in the background of the fact that deceased had developed some sort of passion towards wife of petitioner Maulu Muni. From perusal of case diary, it is evident that none of the witnesses have disclosed that they have ever seen deceased in company of Maulu Muni and so, save and except the motive as

Accordingly, petitioners, Maulu Muni and Bideshi Muni are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Mr. L. B. Paswan, Judicial Magistrate, 1st Class, Purnea in connection with Dhamdaha P. S. Case no. 43 of 2016.
