====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 21-08-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 04.02.2019 in a case for the offence registered under Section 394 of the IPC.

The prosecution story, in brief, is that on 09.05.2018 at around 7.30 P.M., the informant Rajesh Sah, after shutting down his shop, situated at Gisara Bazar, left for his house village-Khopi by his Motorcycle bearing Registration No. BR30K/4868 and on the way, four persons on two Motorcycles overtook the Motorcycle of the informant and surrounded him. One of the accused assaulted on the head of the informant using

No.51405 of 2019(2) dt.21-08-2019 2/3 a short weapon by which he got injured and threatening him, all the four persons snatched his Motorcycle alongwith ornaments kept in the dickey of the Motorcycle, key of his shop, a Samsung Mobile and cash Rs. 40,000/- and thereafter they ran away towards Village-Gisara.

It has been submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on the basis of confession of coaccused. One Motorcycle is said to have been recovered in abandoned condition in front of the house of the petitioner. The petitioner had no knowledge that the Motorcycle in question is a stolen property.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is not named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi, in connection with Runnisaidpur P.S. Case No. 234
