JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-11-2019 This is an application for grant of anticipatory bail in connection with Bihar P.S. Case No. 236 of 2018, disclosing offences under Sections 147, 148, 149, 384, 302, 120B of IPC and Section 27 of the Arms Act.

As per F.I.R. on the order of petitioner and other accused persons, one co-accused Lal Bahadur Yadav fired on the deceased, causing injury to him.

Submission of the learned counsel for the petitioner is that petitioner is not the assailant of the deceased and he has falsely been implicated in this case along with other accused persons. He has no criminal antecedent.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail of the petitioner on the ground that petitioner is named in the F.I.R. and he is order giver along with

Patna High Court CR. MISC. No.51779 of 2019(3) dt.04-11-2019 2/2 the other co-accused persons.

Having heard both sides, in view of the facts and circumstances, as stated above, this application is disposed of with a direction to the petitioner to surrender and pray for regular bail, the same shall be considered by the learned court below on the basis of the materials available on the record as well as the fact that other accused Yogendra Yadav has already been granted privilege of regular bail by a Co-ordinate Bench of this Court, and if possible to be disposed of on the same day.
