In this case, the petitioner is seeking anticipatory bail in connection with Shastri Nagar P.S. Case No.317 of 2018 (G.R. No.3124 of 2018), registered for the offence punishable under Section 370 of the Indian Penal Code and under Section 3/14(i) of the Child Labour Prohibition and Regulation Act, 1986.

Allegation has been made that the Enforcement Directorate has raided the shop of the petitioner and found that a boy of 10 years was working in the said shop and it transpired that he was being paid Rs.3500/- per month, which is very much lower side and he cannot employ a child of 10 years.

No.58351 of 2018(2) dt.28-09-2018 2/2 Looking to the entire facts and circumstances of the case, let the petitioner, namely, Butai Rai, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Sub Judge, IV, Patna, in connection with Shastri Nagar P.S. Case No.317 of 2018 (G.R. No.3124 of 2018) subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
