This is an application for bail in connection with Surajgarha P.S. Case No. 22 of 2017, G.R. No. 111 of 2017, registered for the offences punishable under Section 395 of the Indian Penal Code.
Allegation against the petitioner is of committing dacoity in petrol pump and further it appears that mobile was used with the SIM of the petitioner and he is accused in two other cases also. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and no TIP was held and he is in custody for five months.
Heard learned APP also, who has opposed the prayer for bail.
Patna High Court Cr.Misc. No.44871 of 2017 (3) dt.17-10-2017 2/2 Having heard both sides and in view of criminal antecedents, I am not inclined to grant bail to the petitioner at this stage.
However, once charge has been framed in this case, the court below will release the petitioner on bail to its own satisfaction.
With the above observation, this application is disposed of.
