JUSTICE RAKESH KUMAR ORAL ORDER 08-12-2016 At the very outset, learned counsel for the petitioner submits that in the prayer portion, some error has occurred. Due to typographical mistake, instead of "Sessions Judge-cum-Special Judge", it has been incorrectly typed as "Chief Judicial Magistrate" and, as such, he makes a prayer for allowing him to make correction.

The prayer is allowed.

It may be done in course of the day.

Heard Sri Pawan Kumar, learned counsel for the petitioner and Sri Parmeshwar Mehta, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody since

Patna High Court Cr.Misc. No.42631 of 2016 (2) dt.08-12-2016 2/2 28.07.2016 in Case No. C-78(7)2016 registered for the offence under Section 20(b) of the N.D.P.S. Act and Section 47(b) of the Bihar Excise ( Amendment) Act, 2016, corresponding to Spl. case No. 10 of 2016 has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that it was alleged that in the courtyard of the petitioner, six plants of Ganja were recovered. Learned counsel for the petitioner, by way of referring to the statement made in paragraph3 of the petition, submits that the petitioner is having clean antecedent.

Learned Addl. Public Prosecutor has opposed the prayer for bail.

However, considering the nature of accusation, clean antecedent of the petitioner as well as period of custody, let the petitioner, namely, Bideshi Rishideo @ Bidur Rishideo be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Madhepura in connection with Case No.C/78(7)/2016, corresponding to Spl. Case no.10 of 2016 .
