Petitioner is husband of the informant. The marriage was solemnized in the year 2012. From the First Information Report, it appears the strained relationship started only one month thereafter. The informant waited for sometime with a view to resolve the matrimonial discord and ultimately lodged the case wherein the allegation is of torture and ill treatment at the hands of the petitioner who is husband.

Counsel for the petitioner states that earlier to this, he has filed a Matrimonial Suit No. 103 of 2013 seeking divorce whereafter the present case has been lodged. However, on

Patna High Court Cr.Misc. No.42120 of 2014 (3) dt.21-04-2015 2/2 instruction, it has been stated at the Bar that he is ready and willing to resolve the matrimonial discord and take back wife in the matrimonial home and to keep her with love and dignity. Taking into account the aforesaid submission, the application is disposed of in the following direction: For a period of five weeks from today, no coercive step shall be taken against the petitioner in connection with Amour P.S. Case No 152 of 2013 (G.R. No. 3037 of 2013) pending before learned Chief Judicial Magistrate, Purnea. The petitioner will make his efforts as stated before this Court and thereafter surrender within the aforesaid time and pray for regular bail. The Court below shall consider and dispose of his bail application on its own merit depending upon the facts to be placed before him in accordance with law.
