Silao, District Nalanda. .... .... Petitioner

Versus

The State of Bihar .... .... Opposite Party ====================================================== Appearance :

For the Petitioner : Mr. Anil Kumar Singh, Advocate.

For the Opposite Party : Mr. Narendra Kumar Singh (App) ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 04-09-2015 Heard both sides.

The petitioner seeks bail in a case registered for the offences punishable under Sections 498(A), 304(B) and 34 of the Indian Penal Code.

The brother of the deceased alleged that his sister was married six years ago, but her husband and other in-laws demanded motorcycle and Rs. 2 lakhs. On 06.08.2014 when the informant went to the in-laws' house of his sister, the mother-inlaw of his sister threatened him of dire consequences and ultimately the dead body of his sister was found. It is submitted that the petitioner is father-in-law of the deceased. No specific allegation is made against the petitioner.

Patna High Court Cr.Misc. No.38524 of 2015 (2) dt.04-09-2015 2/2 The marriage solemnized much before the date stated in the FIR. Same fact appears from the Voter Identity Card of the victim of the year 2005. The mother-in-law and the second wife of the husband of the deceased have already been granted anticipatory bail.

On the other hand learned counsel for the informant as well as learned APP vehemently opposed the prayer for bail. Having considered the facts that the petitioner is fatherin-law of the deceased and no specific allegation is made against him, although the marriage of the victim was solemnized before six years, but during subsistence of marriage neither the victim nor the informant made any complaint about the ill-treatment on account of demand of dowry, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda in Silao P.S. Case No. 93 of 2014.
