JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-12-2016 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.

This application is for grant of anticipatory bail for the offence under Sections 384 and 386 of the Indian Penal Code. It is submitted on behalf of the petitioner that the whole allegation is not against the petitioner only rather from perusal of Annexure-3 of the petition, it appears that some other persons have also been registered for the same offence. It has also been submitted that so far mobile number with which the call was made is not of the petitioner as such it can not be said that call was made from the mobile of the petitioner.

Heard learned A.P.P. and the learned counsel for the Opposite Party, who has submitted that there is specific allegation against the petitioner of demand of money also.

No.45517 of 2016 (3) dt.19-12-2016 2/2 Having heard both sides and in view of the fact that in the FIR, there is specific allegation against the petitioner that he visited the house of the informant and made a demand of money and gave the account number for depositing the amount. In view of the aforesaid facts, in my opinion, it is not a fit case for anticipatory bail, let the petitioner is directed to surrender before the court below and the court below will examine all the facts as submitted on behalf of the petitioner with regard to account number as well as the mobile calls and other facts and will dispose of the application on its own merit without being prejudiced of the order of this Court.
